However, don't let the decrease of the past few months&nbsp;fool you.&nbsp; The decrease in foreclosure activities is partially due to the moritoriums many major lenders put on foreclosures over the holiday season.&nbsp; As the&nbsp;moritorium's were lifted in December and January, we'll continue to see an increase in foreclosure filings in to the spring and summer months.</span></p> <p><span class="redtext boldtext">Although these numbers continue to increase, it doesn't have to be discouraging.&nbsp; Home values are still decling in almost&nbsp;every&nbsp;area.&nbsp; The upside is that there are some AMAZING buying opportunities out there right now, and buyer activity has increased.&nbsp; Home prices in a majority of major U.S. cities tracked by a private trade group have fallen to their lowest levels since the housing bubble burst.</p> <p class="byline">&nbsp;The Standard &amp; Poor's/Case-Shiller index fell in December from November in all but one of the 20 cities it tracks. The 20-city index declined 1 percent.</p> <p>&nbsp;Only one major&nbsp;market saw&nbsp; an increase, and that was Washington DC, not Washington State.</p> </div> <div class="body"> <p>Eleven of the markets hit their lowest point since the housing bust, in 2006 and 2007: Atlanta, Charlotte, N.C., Chicago, Detroit, Las Vegas, Miami, New York, Phoenix, Portland, Ore., Seattle and Tampa, Fla.</p> <p>The damage from the real estate bubble now spreads well beyond Las Vegas, Phoenix and Miami, which built frantically during the mid-2000s. In many places, prices are expected to keep falling for at least the next six months.</p> <p>&quot;Unlike the 2006 to 2009 period when all cities saw prices move together, we see some differing stories around the country, said David M. Blitzer, chairman of the Index Committee at Standard &amp; Poor's.</p> <p>Some of the worst declines are in cities hit hard by foreclosures, which are forcing prices down. Many people are holding off making purchases because they fear the market hasn't hit bottom yet.</p> <p>The housing recovery is uneven across the United States, with coastal cities in California and the Northeast faring much better than the Midwest and Southeast. Call the state's foreclosure-prevention hotline: 877- 894-4663.</p> </div> <div class="infobox"> <p class="title"><font color="#0066cc">When he tried to change the terms of his home loan, Michael Guzman was rejected because the bank didn't consider his joblessness a long-term hardship.</font></p> </div> <div class="body"> <p>Kamie Kahlo's bank offered her a modified mortgage on her Queen Anne home but later told her the lower payments weren't permanent.</p> <p>And Leslie Oldham was stunned her bank moved to foreclose on her Kent home before it gave her a decision on a loan modification.</p> <p>&quot;I tried everything I could to work it out with the bank,&quot; said Oldham, 58, &quot;because the last thing I wanted to do was file a bankruptcy.&quot;</p> <p>More than a year since President Obama announced an unprecedented national foreclosure-prevention program, many homeowners' experiences with the program have left them feeling frustrated and angry at mortgage servicers.</p> <p>The program gives servicers financial incentives to permanently lower the monthly payments of homeowners who qualify for and successfully complete a three-month trial period. Servicers can modify a mortgage by lowering the interest rate, extending the loan's terms or deferring payment of principal.</p> <p>Federal auditors say the Treasury Department has failed to hold banks and other servicers accountable for following the loan-modification program's guidelines, and state regulators say there's little they can do.</p> <p>Some examples from the Government Accountability Office:</p> <p>&bull; Delayed decisions: After three months of accepting payments on a modified trial loan, banks are supposed to decide whether to make the new terms permanent. But some banks have a backlog of thousands of homeowners who have been making trial payments for six months or longer.</p> <p>&bull; Inconsistent treatment: Fifteen of the 20 largest servicers in the program didn't follow federal guidelines for evaluating borrowers' loans and may have treated similarly situated borrowers differently.</p> <p>&bull; No meaningful appeals: The Treasury does not independently review borrowers' application or loan files, nor does it have clear penalties for servicers who violate the program's rules.</p> <p>The program was intended to keep 3 million homeowners from foreclosure, but it had produced only about 435,000 permanent modifications through July.</p> <p>Treasury officials say the program's impact can't be measured by a single statistic. Many homeowners who were deemed ineligible for the federal program have been offered private loan modifications by their servicer.</p> <p>Still, six of every 10 seriously delinquent borrowers are not getting help, according to a new study by the State Foreclosure Prevention Working Group. Struggling homeowners are alienated by the mixed messages and long delays, the group said, and almost three-quarters of modified mortgages leave borrowers owing more, not less.</p> <p>&quot;That is not a sustainable solution,&quot; said Roberto Quercia, who consulted on the study and is director of the Center for Community Capital at the University of North Carolina, Chapel Hill. &quot;For people underwater, making the hole deeper is a recipe for disaster.&quot;</p> <p><strong>Jumbled paperwork</strong></p> <p>In March 2009, Treasury officials launched the federal Home Affordable Modification Program (HAMP), its cornerstone effort to rescue the nation's housing market, in which property values have fallen at a rate not seen since the Great Depression.</p> <p>Homeowners must pass three tests to be considered: First, they must have an eligible hardship, such as unemployment. Second, their mortgage must exceed 31 percent of their gross monthly income.</p> <p>Finally, the bank applies a &quot;net present value&quot; test to see if it will lose more money from foreclosing on their home than from modifying the mortgage.</p> <p>Through July, homeowners in the program saw a median 36 percent, or more than $500, savings in their monthly payment after permanent modification, according to the Treasury.</p> <p>But the number of homeowners making trial payments who were dropped from the program &mdash; more than 600,000 &mdash; now exceeds the number with permanent modifications.</p> <p>&quot;Paperwork has been the No. 1 reason homeowners have not been able to convert to permanent modifications,&quot; Treasury spokeswoman Andrea Risotto said.</p> <p>The second most common reason, she said, is that homeowners are unable to keep up with payments during the trial period.</p> <p>Housing counselors and lawyers for homeowners say servicers misplace documents or wrongly reject eligible applicants for no good reason &mdash; even after they've made trial payments for six months or longer.</p> <p>&quot;The servicers are claiming that the files are a mess or are incomplete,&quot; said Marc Cote, a housing counselor who coordinates Washington state's foreclosure-prevention hotline. &quot;We have confirmation the fax was received. Then you call back in two days and there's no record of it. That's not uncommon.&quot;</p> <p>Regulators at the state Department of Financial Institutions say they've been flooded with consumer complaints about mortgage issues &mdash; such as banks failing to properly credit homeowners for payments.</p> <p>Department director Scott Jarvis says a series of federal court decisions since 2002 has made it nearly impossible for regulators to force national banks and thrifts to comply with state consumer-protection laws.</p> <p>&quot;It's a massive shell game,&quot; Jarvis said. &quot;The pea is the consumer, and the consumer ends up getting shuffled around the shells and rarely gets anything resolved.&quot;</p> <p>For their part, big banks and other servicers say they're helping distressed borrowers, while being fair to the majority of homeowners who pay their mortgages on time.</p> <p>This year, Chase opened a loan-modification office in Tukwila that focuses on screening homeowners with Chase mortgages in Washington and Oregon.</p> <p>And a coalition of big banks recently announced support for a Web portal called HOPE LoanPort that housing counselors can use to submit complete applications, verify their receipt and get status updates.</p> <p>&quot;In the end I think we all share a common goal, which is to help as many customers as possible stay in their homes,&quot; said Rebecca Mairone, Bank of America's national default-servicing executive.</p> <p><strong>Left in limbo</strong></p> <p>Cote, the housing counselor, recounts this story: On Aug. 6, a national bank told an elderly owner of an Issaquah house that her application for loan assistance &mdash; submitted March 3 &mdash; was still under review.</p> <p>A week later, a trustee let the bank repossess the woman's house. The bank had denied the woman's application but never notified her in writing, as required.</p> <p>&quot;They're violating the guidelines,&quot; said Cote, whose agency doesn't allow him to identify the national bank.</p> <p>Some Seattle-area homeowners echo Cote.</p> <p>Guzman, of Lake Stevens, has been unemployed for more than two years and was told &mdash; incorrectly &mdash; by Chase last year that his joblessness did not count as a permanent hardship.</p> <p>&quot;Servicers continue to evolve their implementation of HAMP,&quot; Chase said in a statement.</p> <p>Moreover, Chase said, it asked Guzman to reapply for loan assistance, but he has refused.</p> <p>Guzman said he's already submitted paperwork three times.</p> <p>&quot;Millions of people have gone through this wringer like I have,&quot; he said.</p> <p>Kahlo, who bought her Queen Anne home in 1999, said she did everything Bank of America asked her to do to qualify for relief under the federal program.</p> <p>After the bank told her it wasn't permanently modifying her mortgage, she sued, alleging it had violated the federal program's rules.</p> <p>Bank of America sought to dismiss the suit, saying the lower monthly payment it offered her was an alternative to the federal program.</p> <p>&quot;A participating servicer is not required to modify every HAMP-eligible loan,&quot; the bank stated in court.</p> <p>Without a permanent modification, Kahlo says, she's in limbo. &quot;I don't know if I'm sleeping in their home or my home,&quot; she said.</p> <p>Declaring bankruptcy was a last resort for Oldham, a widow in Kent who manages payroll for a small construction company.</p> <p>But she believed she had no recourse because Bank of America foreclosed on the manufactured home she's lived in for 15 years.</p> <p>Oldham said she got behind on her mortgage because of medical bills.</p> <p>She applied for a modification last year, but the bank tacked a foreclosure notice on her door before she received an answer.</p> <p>Oldham complained to the state Attorney General's Office, which passed her on to the state Department of Financial Institutions. When you borrowed the money you were not required to include the loan proceeds in income because you had an obligation to repay the lender. When that obligation is subsequently forgiven, the amount you received as loan proceeds is normally reportable as income because you no longer have an obligation to repay the lender. The most common situations when cancellation of debt income is not taxable involve:</p> <ul> <li>Qualified principal residence indebtedness: This is the exception created by the Mortgage Debt Relief Act of 2007 and applies to most homeowners.</li> <li>Bankruptcy: Debts discharged through bankruptcy are not considered taxable income.</li> <li>Insolvency: If you are insolvent when the debt is cancelled, some or all of the cancelled debt may not be taxable to you. You are insolvent when your total debts are more than the fair market value of your total assets.</li> <li>Certain farm debts: If you incurred the debt directly in operation of a farm, more than half your income from the prior three years was from farming, and the loan was owed to a person or agency regularly engaged in lending, your cancelled debt is generally not considered taxable income.</li> <li>Non-recourse loans: A non-recourse loan is a loan for which the lender&rsquo;s only remedy in case of default is to repossess the property being financed or used as collateral. That is, the lender cannot pursue you personally in case of default. Forgiveness of a non-recourse loan resulting from a foreclosure does not result in cancellation of debt income. However, it may result in other tax consequences.</li> </ul> <p>These exceptions are discussed in detail in Publication 4681.<br /> <br /> <strong>What is the Mortgage Forgiveness Debt Relief Act of 2007?</strong><br /> The Mortgage Forgiveness Debt Relief Act of 2007 was enacted on December 20, 2007 (see News Release IR-2008-17). Generally, the Act allows exclusion of income realized as a result of modification of the terms of the mortgage, or foreclosure on your principal residence.<br /> <br /> <strong>What does exclusion of income mean?<br /> </strong>Normally, debt that is forgiven or cancelled by a lender must be included as income on your tax return and is taxable. But the Mortgage Forgiveness Debt Relief Act allows you to exclude certain cancelled debt on your principal residence from income. Debt reduced through mortgage restructuring, as well as mortgage debt forgiven in connection with a foreclosure, qualifies for the relief.<br /> <br /> <strong>Does the Mortgage Forgiveness Debt Relief Act apply to all forgiven or cancelled debts?<br /> </strong>No. The Act applies only to forgiven or cancelled debt used to buy, build or substantially improve your principal residence, or to refinance debt incurred for those purposes. In addition, the debt must be secured by the home. This is known as qualified principal residence indebtedness. The maximum amount you can treat as qualified principal residence indebtedness is $2 million or $1 million if married filing<br /> separately.<br /> <br /> <strong>Does the Mortgage Forgiveness Debt Relief Act apply to debt incurred to refinance a home?</strong><br /> Debt used to refinance your home qualifies for this exclusion, but only to the extent that the principal balance of the old mortgage, immediately before the refinancing, would have qualified. For more information, including an example, see Publication 4681.<br /> <br /> <strong>How long is this special relief in effect?<br /> </strong>It applies to qualified principal residence indebtedness forgiven in calendar years 2007 through 2012.<br /> <br /> <strong>Is there a limit on the amount of forgiven qualified principal residence indebtedness that can be excluded from income?<br /> </strong>The maximum amount you can treat as qualified principal residence indebtedness is $2 million ($1 million if married filing separately for the tax year), at the time the loan was forgiven. If the balance was greater, see the instructions to Form 982 and the detailed example in Publication 4681.<br /> <br /> <strong>If the forgiven debt is excluded from income, do I have to report it on my tax return?<br /> </strong>Yes. The amount of debt forgiven must be reported on <a href="http://www.irs.gov/pub/irs-pdf/f982.pdf"><font color="#0066cc">Form 982</font></a> and this form must be attached to your tax return.<br /> <br /> <strong>Do I have to complete the entire Form 982?<br /> </strong>No. Form 982, Reduction of Tax Attributes Due to Discharge of Indebtedness (and Section 1082 Adjustment), is used for other purposes in addition to reporting the exclusion of forgiveness of qualified principal residence indebtedness. If you are using the form only to report the exclusion of forgiveness of qualified principal residence indebtedness as the result of foreclosure on your principal residence, you only need to complete lines 1e and 2. If you kept ownership of your home and modification of the terms of your mortgage resulted in the forgiveness of qualified principal residence indebtedness, complete lines 1e, 2, and 10b. Attach the Form 982 to your tax return.<br /> <br /> <strong>Where can I get this form?<br /> </strong>If you use a computer to fill out your return, check your tax-preparation software. You can also download the form at IRS.gov, or call 1-800-829-3676. If you call to order, please allow 7-10 days for delivery.<br /> <br /> <strong>How do I know or find out how much debt was forgiven?<br /> </strong>Your lender should send a Form 1099-C, Cancellation of Debt, by February 2, 2009. The amount of debt forgiven or cancelled will be shown in box 2. If this debt is all qualified principal residence indebtedness, the amount shown in box 2 will generally be the amount that you enter on lines 2 and 10b, if applicable, on Form 982.&nbsp;<br /> <br /> <strong>Can I exclude debt forgiven on my second home, credit card or car loans?<br /> </strong>Not under this provision. Only cancelled debt used to buy, build or improve your principal residence or refinance debt incurred for those purposes qualifies for this exclusion. See Publication 4681 for further details.<br /> <br /> <strong>If part of the forgiven debt doesn't qualify for exclusion from income under this provision, is it possible that it may qualify for exclusion under a different provision?<br /> </strong>Yes. The forgiven debt may qualify under the insolvency exclusion. Normally, you are not required to include forgiven debts in income to the extent that you are insolvent.&nbsp; You are insolvent when your total liabilities exceed your total assets. The forgiven debt may also qualify for exclusion if the debt was discharged in a Title 11 bankruptcy proceeding or if the debt is qualified farm indebtedness or qualified real property business indebtedness. If you believe you qualify for any of these exceptions, see the instructions for Form 982. Publication 4681 discusses each of these exceptions and includes examples.<br /> <br /> <strong>I lost money on the foreclosure of my home.&nbsp;Can I claim a loss on my tax return?<br /> </strong>No.&nbsp; Losses from the sale or foreclosure of personal property are not deductible.&nbsp;<br /> <br /> <strong>If I sold my home at a loss and the remaining loan is forgiven, does this constitute a cancellation of debt?<br /> </strong>Yes. To the extent that a loan from a lender is not fully satisfied and a lender cancels the unsatisfied debt, you have cancellation of indebtedness income.&nbsp;If the amount forgiven or canceled is $600 or more, the lender must generally issue Form 1099-C, Cancellation of Debt, showing the amount of debt canceled.&nbsp;However, you may be able to exclude part or all of this income if the debt was qualified principal residence indebtedness, you were insolvent immediately before the discharge, or if the debt was canceled in a title 11 bankruptcy case.&nbsp; An exclusion is also available for the cancellation of certain nonbusiness debts of a qualified individual as a result of a disaster in a Midwestern disaster area.&nbsp; See Form 982 for details.<br /> <strong><br /> If the remaining balance owed on my mortgage loan that I was personally liable for was canceled after my foreclosure, may I still exclude the canceled debt from income under the qualified principal residence exclusion, even though I no longer own my residence?&nbsp;<br /> </strong>Yes, as long as the canceled debt was qualified principal residence indebtedness. See Example 2 on page 13 of Publication 4681, Canceled Debts, Foreclosures, Repossessions, and Abandonments.<br /> <strong><br /> Will I receive notification of cancellation of debt from my lender?<br /> </strong>Yes. Lenders are required to send Form 1099-C, Cancellation of Debt, when they cancel any debt of $600 or more. The amount cancelled will be in box 2 of the form.<br /> <br /> <strong>What if I disagree with the amount in box 2?<br /> </strong>Contact your lender to work out any discrepancies and have the lender issue a corrected Form 1099-C.<br /> <br /> <strong>How do I report the forgiveness of debt that is excluded from gross income?<br /> </strong>(1) Check the appropriate box under line 1 on Form 982, Reduction of Tax Attributes Due to Discharge of Indebtedness (and Section 1082 Basis Adjustment) to indicate the type of discharge of indebtedness and enter the amount of the discharged debt excluded from gross income on line 2.&nbsp; Any remaining canceled debt must be included as income on your tax return.<br /> <br /> (2) File Form 982 with your tax return.<br /> <br /> <strong>My student loan was cancelled; will this result in taxable income?<br /> </strong>In some cases, yes. Your student loan cancellation will not result in taxable income if you agreed to a loan provision requiring you to work in a certain profession for a specified period of time, and you fulfilled this obligation.<br /> <br /> <strong>Are there other conditions I should know about to exclude the cancellation of student debt?<br /> </strong>Yes, your student loan must have been made by:</p> <p dir="ltr">(a) the federal government, or a state or local government or subdivision;<br /> <br /> (b) a tax-exempt public benefit corporation which has control of a state, county or municipal hospital where the employees are considered public employees; or<br /> <br /> (c) a school which has a program to encourage students to work in underserved occupations or areas, and has an agreement with one of the above to fund the program, under the direction of a governmental unit or a charitable or educational organization.</p> <p><strong>Can I exclude cancellation of credit card debt?<br /> </strong>In some cases, yes. Nonbusiness credit card debt cancellation can be excluded from income if the cancellation occurred in a title 11 bankruptcy case, or to the extent you were insolvent just before the cancellation. At what point do borrowers walk?http://www.westernwashingtonshortsales.com/1168680/2010/06/30/Strategic-Defaults-in-Bellevue-and-Seattle-Washington.aspx<p><em>Interesting article from the Wall Street Journal this week.&nbsp; Watching what is happening, in Arizona, California, and Neveda is a real good indicator of what Washington State will experience down the road.</em></p> <p>&nbsp;</p> <p>&nbsp;<b><font size="6">How Far Underwater Do Borrowers Sink Before Walking Away?</font></b></p> <div>At what point do borrowers who owe more than their homes are worth decide to stop paying the mortgage?</div> <div>A&nbsp;<a title="http://www.federalreserve.gov/pubs/feds/2010/201035/201035abs.html" href="http://www.federalreserve.gov/pubs/feds/2010/201035/201035abs.html"><span>new study</span></a>&nbsp;from economists at the Federal Reserve Board aims to answer that question. The research found that the median borrower who &ldquo;strategically&rdquo; defaults doesn&rsquo;t walk away from the mortgage until the amount owed exceeds the value of the home by 62%.</div> <div>The study is bad news for the mortgage industry in that it backs up&nbsp;<a title="http://online.wsj.com/article/SB126100260600594531.html" href="http://online.wsj.com/article/SB126100260600594531.html"><span>the idea</span></a>&nbsp;that a growing share of borrowers are walking away from loans.&nbsp;<a title="http://online.wsj.com/article/SB10001424052748704629804575325113962811380.html" href="http://online.wsj.com/article/SB10001424052748704629804575325113962811380.html">Concerns are mounting</a>&nbsp;among lenders and investors that some borrowers who owe far more than their homes are worth are now choosing not to pay mortgages that they can afford.</div> <div>But the silver lining here is that it suggests a rather high threshold for borrowers to walk away.</div> <div>&ldquo;The fact that many borrowers continue paying a substantial premium over market rents to keep their homes challenges traditional models of hyper-informed borrowers&rdquo; choosing to simply walk away, the authors write. The results suggest &ldquo;that borrowers face high default and transaction costs&rdquo; that make strategic defaults less widespread than they might otherwise be.</div> <div>The study examined borrowers in Arizona, California, Florida and Nevada who bought homes in 2006 with no money down. Nearly 80% of those borrowers had defaulted by September 2009. The authors then attempt to estimate and separate out defaults caused by job loss and other income shocks from those that had been spurred simply by negative equity.</div> <div>Nearly 80% of all defaults in the sample resulted from the traditional combination of income shocks and negative equity. But for borrowers that had a loan-to-value ratio of 150%, half of all defaults were strategic defaults, driven purely by negative equity.</div> <div>Most defaults are typically driven by a combination of income shock and negative equity, or what&rsquo;s known as the &ldquo;double-trigger&rdquo; hypothesis. While borrowers who lose their jobs but have equity in their homes can sell and avoid default, those without any equity are left with fewer options.</div> <div>&ldquo;Borrowers do not ruthlessly exercise the default option at relatively low levels of negative equity, broadly consistent with the &lsquo;double-trigger&rsquo; hypothesis,&rdquo; the authors write. &ldquo;But by the time equity falls below -50%, [half] of defaults appear to be strategic.&rdquo;</div> <div>(<a title="http://blogs.wsj.com/developments/2010/06/28/how-far-underwater-do-borrowers-sink-before-walking-away/tab/2010/06/28/study-nearly-one-in-five-mortgage-defaults-are-strategic/" href="http://blogs.wsj.com/developments/2010/06/28/how-far-underwater-do-borrowers-sink-before-walking-away/tab/2010/06/28/study-nearly-one-in-five-mortgage-defaults-are-strategic/"><span>Read about a separate study</span></a>&nbsp;released on Monday that finds that around one in five mortgage defaults could be considered &ldquo;strategic.&rdquo;)</div> <div>Empirical evidence suggests that more borrowers may be walking away from their primary residences, but this is a much bigger problem in housing markets that saw stunning home-price gains followed by a free fall. Look to the desert suburbs of Phoenix and Las Vegas, the southwestern coast of Florida, and the far-flung exurbs of California&rsquo;s San Joaquin Valley and Inland Empire.</div> <div>The Fed study finds,&nbsp;<a title="http://blogs.wsj.com/developments/2010/06/28/how-far-underwater-do-borrowers-sink-before-walking-away/tab/2009/10/23/report-sheds-light-on-why-homeowners-walk-away/" href="http://blogs.wsj.com/developments/2010/06/28/how-far-underwater-do-borrowers-sink-before-walking-away/tab/2009/10/23/report-sheds-light-on-why-homeowners-walk-away/"><span>as have others before</span></a>, that borrowers are more likely to walk away from homes in states where lenders can&rsquo;t sue them for a deficiency judgment. The median borrower in a state where lenders have recourse to borrowers&rsquo; assets, such as Florida or Nevada, defaults when he or she is 20 to 30 percentage points further underwater than the same borrower in a non-recourse state, such as Arizona or California.</div> <div>&nbsp;</div> <div>Borrowers with higher credit scores also find it more costly to default.
